for the use of the Kita-Job platform

  1. Scope of Application
    (1) These General Terms and Conditions (GTC) apply to all contracts between Kita-Job (hereinafter referred to as "Kita-Job") and clients (hereinafter referred to as "Employers") who book paid services for posting job advertisements on the platform www.kita-job.com.
    (2) Employers within the meaning of these GTC are exclusively companies, organizations, day care centers, or other institutions. Applicants are not contractual partners of Kita-Job.
    (3) Deviating or opposing conditions of the employer do not apply unless Kita-Job expressly agrees to their validity in writing.

  2. Subject of the Contract
    (1) The subject of the contract is the temporary publication of job advertisements of the employer on the Kita-Job platform according to the selected pricing plan.
    (2) Kita-Job is obligated solely to provide the advertising space, but not the success of hiring, a specific number of applications, or the quality of the applications.
    (3) Kita-Job does not provide recruitment services and does not act as an employer.

  3. Booking and Conclusion of Contract
    (1) The booking is made online via the Kita-Job website using a paid pricing plan.
    (2) By completing the booking, the employer submits a binding offer to conclude a contract. The contract is concluded upon successful completion of the booking process.
    (3) The publication of the job advertisement will only take place after full payment and after content review and approval by Kita-Job.

  4. Prices and Payment Terms
    (1) All listed prices are in euros and plus the applicable VAT, if any.
    (2) Payment is made in advance using the payment methods offered during the booking process.
    (3) There is no right to publication before the payment is received.

  5. Publication, Review, and Approval
    (1) Each job advertisement will be editorially reviewed before publication.
    (2) Kita-Job reserves the right to reject advertisements:

  • in whole or in part,

  • to propose changes or reductions,

  • to remove temporarily or permanently.
    (3) Reasons for rejection may include:

  • illegal content,

  • violations of the General Equal Treatment Act (AGG),

  • discriminatory or misleading formulations,

  • incomplete or contradictory information.
    (4) There is no right to publish specific content.

  1. Duties of the Employer
    (1) The employer agrees to provide only truthful, legally permissible, and complete information.
    (2) The employer is solely responsible for the content of the job advertisement and guarantees that:

  • no third-party rights are violated,

  • all legal requirements (especially AGG) are complied with,

  • the employer has all necessary usage rights for texts, logos, and images.
    (3) The employer indemnifies Kita-Job from any claims by third parties arising from the advertisement.

  1. Duration and Termination
    (1) The duration of a job advertisement depends on the selected pricing plan.
    (2) The duration starts from the day of approval, not the purchase date.
    (3) After the duration expires, the advertisement will be automatically deactivated or removed.
    (4) Early termination by the employer is possible but does not entitle to a refund.

  2. Right of Withdrawal
    (1) The offer of Kita-Job is exclusively directed to entrepreneurs within the meaning of § 14 of the German Civil Code (BGB).
    (2) The employer explicitly agrees that Kita-Job will begin providing the service before the statutory withdrawal period expires.
    (3) With the start of the service, the right of withdrawal expires.

  3. Liability
    (1) Kita-Job is only liable for damages caused by intentional or grossly negligent breaches of duty.
    (2) For simple negligence, Kita-Job is only liable for the violation of essential contractual obligations and limited to the typical, foreseeable damage.
    (3) Kita-Job does not assume liability for the success of the job advertisement, in particular not for:

  • the submission of applications,

  • the suitability of applicants,

  • a successful placement.

  1. Usage Rights
    (1) The employer grants Kita-Job for the duration of the contract the simple, time-limited right to publish the job advertisement:

  • on the website,

  • in connected online channels,

  • within the scope of promoting the advertisement.
    (2) This right automatically expires at the end of the advertisement's duration.

  1. Data Protection
    (1) The processing of personal data is carried out in accordance with applicable data protection laws, in particular the General Data Protection Regulation (GDPR).
    (2) Applications are transmitted directly to the contact address provided by the employer.
    (3) Further information can be found in the privacy policy on the Kita-Job website.

  2. Final Provisions
    (1) The law of the Federal Republic of Germany applies.
    (2) The place of jurisdiction is – to the extent permitted by law – the seat of Kita-Job.
    (3) If any provision of these GTC is invalid or becomes invalid, the validity of the remaining provisions shall remain unaffected.
